I think two questions remain:
1. If it was Cuban's sole purpose to promote HDNet and the Artist's work, why are DVD's being sold?
2. If he had made clear to the artists that their work would be sold and that they would receive nothing; how many artists would have agreed?
Claiming he is offsetting costs and no 'profit' was made may be solid legal ground for him to stand on.
That does not and will not change the perception of being deceptive.
